These General Terms and Conditions of Sale govern the terms and conditions under which COFFEE EXPRESS  (hereinafter the "Seller") will provide the user (hereinafter the "User") with products for sale online on the website https://coffee1993.it/ (hereinafter the "Site"). If the User does not accept these General Terms and Conditions of Sale, he/she shall not be able to place purchase orders for any Products on sale on the Site.

The parties to the contract are:

– COFFEE EXPRESS, with registered office in Pisticci (MT), Strada Provinciale Pisticci-San Basilio SNC, 75015, Partita P.IVA 01227870779,

- Customer: the final consumer, i.e. the individual acting for purposes outside his or her trade or profession.

Conclusion of the contract

The purchase order manifests the User's willingness to purchase the Product(s) indicated in the relevant purchase order (hereinafter "Order"). The Order will be considered issued upon completion of the online purchase procedure, in the appropriate section within the Site. After placing your Order, you will receive an email confirming receipt of the Order in which the Order Identification Number and details of the Product(s) ordered will be indicated (hereinafter "Order Summary"). Please note that the Order Summary is only a communication from COFFEE EXPRESS that it has received the Order placed by the User and, therefore, the Order shall not yet be deemed to have been accepted by COFFEE EXPRESS. All Orders for a Product will in fact be subject to specific acceptance by COFFEE EXPRESS and will be considered accepted (and the contract for the online sale and purchase of the Product will be considered concluded) when the User receives an email confirming that the Product has been shipped (hereinafter "Shipment Confirmation”).

COFFEE EXPRESS reserves the right, at its absolute discretion, to refuse an Order if it deems it appropriate. If COFFEE EXPRESS refuses an Order the User will be contacted by Customer Service by e-mail to be informed and will receive a refund for any payment already made.

Upon receipt of the Shipment Confirmation by the User, the online Product sale and purchase contract shall be deemed concluded and fully binding on the User and COFFEE EXPRESS.

Delivery of goods

Product availability is indicated in the COFFEE EXPRESS online catalogue alongside each product. The delivery times indicated are not binding, unless otherwise stated in a separate agreement. However, the seller does everything in its power to respect these times.
Upon receipt of the goods, the buyer must immediately check that the delivery is complete and correct and inform the seller of any problems within the day following the delivery.

Price and shipping costs

The price indicated on the website is not binding and only becomes so when the order is confirmed for shipment.
It may happen that the prices indicated on the site are incorrect. In this case, the customer has the right to withdraw from the sales contract and to receive a refund, if he has already paid.

Payment

Orders placed on https://coffee1993.it/ can be paid for by bank transfer in advance, PayPal or cash on delivery. Further information can be found on the Payment Method page.

Right of withdrawal

Pursuant to Article 52 of Legislative Decree 206/2005 ("Codice del Consumo"), the User may withdraw from the Contract within 14 days from the date of delivery of the Product. To comply with the withdrawal period, it is sufficient for the User before the expiry of the withdrawal period to send COFFEE EXPRESS within and no later than 14 days from the date of delivery of the Product, specific communication by e-mail to info@coffee1993.it indicating the Order Identification Number and the desire to withdraw from the Contract.
Following such notice of withdrawal, the User shall send the Product - no later than 14 days from the date on which he communicated the withdrawal to the Seller - to the following address:

It is understood that shipping costs shall be charged to the User, who shall in any case be responsible for the integrity of the Product until its delivery to the Seller.

The right of withdrawal is however subject to the following conditions:

  • The right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on a part of the purchased product;
  • The right does not apply to sealed products once opened;
  • The purchased goods must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); in order to limit damage to the original packaging, we recommend, when possible, inserting it in a second box, on which to affix the destination address; in all cases the affixing of labels or adhesive tapes directly on the original product packaging must be avoided;
  • In accordance with the law, the shipping costs for the return of the goods shall becharged to the customer; the costs for sending the goods to the customer shall not be reimbursed, as the service has been properly provided.
  • Shipment, until the certificate of receipt in our warehouse, is full responsibility of the customer;
  • in the event of damage to the goods during transport, COFFEE EXPRESS will inform the customer of what has happened (within 5 working days of receipt of the goods in its warehouses), to enable him to file a timely complaint against the courier of his choice and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, and the request for withdrawal will be cancelled;
  • COFFEE EXPRESS is not liable in any way for damage to or theft/loss of goods returned by uninsured shipments;
  • On its arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport. If the box and/or original packing are damaged, COFFEE EXPRESS will deduct a percentage from the refund due, in any case no more than 10% of the same, as a contribution to restoration costs.

Complaints

Any complaints regarding the delivery of the products and their characteristics at the time of delivery must be reported to info@coffee1993.it.
